1) What does REA stand for?

It stands for Registro de Empresas Acreditas. And it means the Registry for Acredited Companies. It was created by law in order to register companies (in the construction sector) that comply with Health and Safety requirements. We can help you with your REA Registration in Spain.

2) What is its background?

The Registry, the “Registro de Empresas Acreditas” was created by law in 2006. That law was implemented with the goal to make (sub) contracting in the construction business safer with respect to working conditions and health and safety. Too often (sub) contracting, the externalizing of work, resulted in the weakening of working conditions and solid health and safety measures. (Sub) contracting too often fails to take care of such required conditions. Therefore, the Registry is public and can be consulted to check whether companies have proved before the Registry that they comply with certain requirements.

3) What does the Registro de Empresas Acreditadas require for inscription?

Apart from describing the company´s organisation (in tools and HR), the activity it is going to carry out, foreign companies must show that 1) its directors and employees have had the required health and safety training and 2) it has an health and safety board, internal or external. And, exactly, these last two requirements often cause concern.

4) How to fulfill the training and health and safety board requirements?

Regulation states that EU companies must show, in that respect, compliance with the law in the home Member State. With what law? With the law in their home Member State that implemented articles 7 and 12 of the 89/391 Directive.

5) And what about the different regional Registros de Empresas Acreditadas?

Every autonomous region in Spain has a Registro de Empresa Acreditada. And foreign companies should register in the particular registry of the region where they are going to provide their services in Spain for the first time.

Posting of Employees

REA Registry (Registro de Empresas Acreditadas) in Spain

The REA Registry in Spain and posting of employees is mandatory for foreign companies that work on Spanish construction sites. Spanish health and safety legislation created such REA registry (in Spanish Registro de Empresas Acreditadas) in order to achieve higer professionalism and labor stability. It is obligatory for both Spanish and foreign companies that either work as contractor or subcontractor in Spain. https://expinterweb.mites.gob.es/rea/

The company should register with the REA Registry where its local Spanish branch is domiciled. If a foreign company does not have a local Spanish subsidiary, there is no rule that prevents it from choosing the REA Registry it deems opportune.

It is not necessary to set up a local company in Spain. Often we hear clients tell us that they were informed to set up a local company. That is not necessary for REA registration.

We have had various clients asking whether it is necessary to set up a local company to register for REA (Registro de Empresas Acreditadas) in Spain. The answer is: No local company is needed for REA registration. Foreign companies can register for REA without any problem. We do that frequently, see our recommendations. Reasons

Firstly, Setting up in order to get a REA accreditation is not necessary and, secondly it will also bring extra paperwork (i.e. headache) with it. As with the setting up of a local entity you subject yourself to the Spanish rules around health and safety requirements for registering. Which is something you dont have to do if you register your foreign company (you still need to do health and safety paperwork, but not the Spanish kind). Thirdly, your Spanish or foreign company cannot piggyback off of the REA registration of the other. So once you would have set up a Spanish local company, if the employees that you need for the job are employed by your foreign company, it still requires a REA registration.

All in all, setting up a local company just for REA purposes is making things complicated.
